Assault and Battery Under Virginia Law

Under Va. Code § 18.2-57, assault is an attempt or offer to do bodily harm with the present ability to do so. Battery is the actual unwanted touching. Most charges are brought as “assault and battery.” A simple conviction is generally a Class 1 misdemeanor (up to 12 months in jail and/or a fine up to $2,500).

Penalties increase in common situations:

  • Assault on a law enforcement or public safety officer — Class 6 felony with a mandatory minimum of six months. These cases often involve body-worn camera footage and aggressive prosecution.

  • Assault on a school official — Mandatory minimum of two days in jail even on a misdemeanor.

  • Hate-crime enhancement — Mandatory minimum of 30 days when the assault is based on race, religion, color, or national origin.

 

Common Defenses

  • Self-defense or defense of others

  • Lack of intent to cause harm or offensive contact

  • Credibility of the complaining witness

  • Body-camera or other video that undercuts the allegation

  • Mutual combat or a primary aggressor situation
